Online Public Schooling for split parents

My niece is a married mother but her first born child is from another father who is objecting to homeschooling. She would like to do an online charter school and since it is a public school would the courts keep her from doing that?

Charter schools are still technically public schooling, not homeschooling, so no court is going to block that on the basis of it not being good enough, or use it against you in custody hearings. There is no legal basis. Even full homeschooling would probably be ok, unless it's shared custody rather than sole custody.

Caveat, I'm not a lawyer.
